枫下茶话 / 美国话题 / URGENT!!!! I already got job offer in US. Now applying J1 waiver of the two years' residency requirement. I already got NOT OBJECTION LETTER from Canadian Government.(becasue I am PR of Canada)Now they asking for Sponsor's view. And I asked my Sponsor and I was told that they will say "against" my waiver!!!!!! They said it is US federal government policy because I received funding from US government (actually only $2400 ), then they have to against!!!! Is there any way to play around? Thanks a lot!!! Very sad about that!!!

Not yet. Potentially, my waiver will be refused, if my sponsor's view is object to my waiver. I only got $2400 from USgovernment. It is really unfair!!! And I already got a job offer in US and my husband is in US :( Help!!!
1. How can I stop them to send a negative sponsor's view
2. Can I hire a lawyer to help with this?
If the waiver is turned down, my life will be totally destoryed!!!

If you got any funding from US Government then you get big trouble for the waiver of two-year home country residence, no matter how much you got.

为了保证正常的人材交流(主要是学术),美国法律规定持J1(配偶J2)在完成后必须回原住国服务两年.这个条件可以被赦免如果得到原住国同意.但有个前提是没有拿美国政府的资金.

I do not know that before coming to US. Otherwise I will not accept this internship for sure!!!! Nobody told me that. They just told me there is 2 year residency requirement. I do not knowit is impossible to waiver it. Before coming, I asked them and I was told that I am living in Canada so probably not applicable to me. (I still have the email in writing. So I think I should able to complain it somewhere). Do you any suggestion to play around? Or I need to hire a lawyer? Thanks.

And it surprises me that it takes 5 months for the No Objection application. In their offical website, it says 3-4 months :(

And, if I cannot stop the negative sponsor's view, after 5 months, I will receive an answer of "your waiver application is turned down". That's terrible!!!

I plan to go back to Canada first. And apply H1 from there. But I need the waiver of the "2 year foreign residency requirement" first. Otherwise I cannot apply H1 at all!!!

You are right. You can not apply H1 within 2 years. You have to return to Canada.

I am not going to change my status. I just want to get the waiver. I talked to the person who is writing the sponsor's view, the case will be pended until Monday. There is at least one thing I can do. They toldme that they have policy to say NO to all waivers. But nobody told me that policy before I am coming. It is cheating!!! Can I appeal it?
