Hello, I got your email, I seldom check my rolia email. Sorry for late responses. I post here in case some one need it. When I applied H1B, I hold canadian degree. Here are my thoughts ONLY.

2. If you are PR of Canada, should be ok.
Logically, "Home Country" means China for you and us, but technically it should be Canada, because you are resident of Canada . US consulate may check your background based on your records mostly in Canada. Same thing applies to B class.

Consular officers in Canada may be unable to properly assess the circumstances of and/or evaluate foreign documents presented by applicants who are visitors in Canada. 3. I797 or any I94 is from INS while Visa is issued by Department of State. They may or may not respect each others' decision, depends how lucky you are.
4. Bring all of the documents, but give only what they ask, answer only what they question.

      • Two copies have been sent, one for you, one for American Consulate General office of beijing. Beijing office will issue you H1B visa if they do receive another copy from U.S to match your copy of letter.That's it.

      1. I think many people applied for H1B in Canada successfully.

      2. I remember someone suggested that in situation like this, you could get degree notarization at University of Toronto, contact student service, ask which office offers such service.

      • Thanks a lot, mssg. I had my degrees notarized at a US Institution when I apply the H1-B visa. If they "strongly urge" me to apply in my home country, I will "strongly" insist them issue me a visa in Canada.

    • If you did get a letter for applying visa after your employer had sent your application, another copy of yours had already been sent to china. If you insist them issue a visa in Canada, may be too late.
      • Nothing sent to China at all. Everything is normal: I-797B, I-129, LCA. They are unable to evaluate my academic credentials. So, "strongly urged"......It's the same for everyone who apply the H1-b visa.
        I just want to learn some experience about getting the visa.
        • Have you signed the offer letter? Have you got approved by INS?
          • I have the employment letter and the approved files by INS. But I was told that it is not necessary to show the emloyment contract to the consular.
