The following sets out the terms and conditions upon which persons ("Participants") who register for the BlueLine service (the "Service") agree to accept the service. To receive the Service, Participants must accept and, at all times comply with, these terms and conditions.
The Service is provided and operated by Onlinetel Inc. (the "Service Provider"). The role of Labatt Breweries of Canada is that of a sponsor of the Service. In these terms and conditions, references to the "Service Sponsors" include Labatt Breweries of Canada and any other sponsor or advertiser of the Service.
The Service is available only to individuals who are legal residents of Ontario, who are 19 years of age or older, who have access to their own phone line.
Participants are required to register for the Service at www.LabattBlueLine.com. Upon registering, Participants will be assigned a personal identification number ("PIN") which they will use to access the Service. Participants must safeguard their PIN and must not transfer or share the PIN with any other person.
This agreement is not assignable and the Service is not transferable.
The Service may not be used to call pay-per-call telephone services (i.e. 1-900 numbers) send facsimiles, for promotional purposes, business purposes or re-sale. The Service may not be used for any other improper or illegal purpose, including making unwanted, harassing or obscene telephone calls.
The Service Provider reserves the right to discontinue, restrict and/or deny the Service to any Participant that, in the Service Provider's sole opinion, is misusing or improperly using the Service in any way.
If the Service is misused or otherwise improperly used by any Participant, that Participant will reimburse the Service Provider and the Service Sponsors for any loss or damage suffered by the Service Provider and the Service Sponsors.
The Service Provider and the Service Sponsors cannot, and do not, guarantee or warrant uninterrupted working of the Service. No compensation or adjustment to rates and charges otherwise owing by the Participant shall be made in the case of any interruption to the Service. The Service Provider and the Service Sponsors will not be liable to the Participant or any other person for any damages, loss of profits, loss of earnings, loss of business opportunities or other loss resulting directly or indirectly out of or in connection with this agreement or in connection with the Service, or any use of the Service Provider's and/or the Service Sponsors' services or equipment, or any acts or omissions of a telecommunications carrier whose facilities are used in establishing connections. In no event shall the Service Provider, the Service Sponsors or their officers, directors, employees, contractors or agents be liable for incidental, consequential, special or indirect damages arising from provision of, or failure to provide any service to the user or others including liability for breach of provisions of this service or agreement, or for any tort including, without limitation, the negligence of the Service Provider and/or the Service Sponsors or any of their directors, officers, employees, contractors or agents. Without limiting the generality of the foregoing, such excluded damages and expenses shall include loss of goodwill, loss of profits, loss of use and any claims made against the Participant by a third party.
The Service may be terminated, and these terms and conditions may be amended at any time without prior notice or obligation to Participants. Any such amendments to the terms and conditions shall be posted on this website. Participants' continued use of the Service shall constitute acceptance of the amended terms and conditions. Participants who do not accept the amendments must cease using the Service and must provide notice of such to the Service Provider. Participants agree and acknowledge the sufficiency of method set our herein for notifying them of any amendments to the terms and conditions.
Any attempt by a Participant or any other person to deliberately alter or damage the Service or undermine the legitimate operation of the Service or this website is a violation of criminal and civil laws and should such an attempt be made, the Service Provider and/or the Service Sponsors reserve the right to discontinue the Service to the Participant or person and seek damages and/or any other remedy available at law from any such Participant or person to fullest extent permitted by law.
This is the entire agreement between the Participant and the Service Provider, and the Service Provider and Service Sponsors do not make any other representations, warranties or guarantees regarding the Service. The Service Provider and Service Sponsors disclaim any and all warranties (explicit or implied) in connection with the Service and this website. If any portion of this agreement is determined to be invalid, the rest of this agreement shall remain in full force and effect.
Use of Information: Participants consent to the receipt and exchange of information by and between/among the Service Provider, the Service Sponsors and the Participant for the purposes of the Service. Participants consent to receiving communications for the Service Provider and/or the Service Sponsors regarding the Service. In addition, if a Participant indicated his/her consent by checking the box provided, the Service Provider, Service Sponsors and their affiliates, or their agents (the "Companies") may use the information: (a) to initiate, maintain, and develop a relationship with the Participant in connection with offering the Companies' products; (b) to promote and market to the Participant additional products and services offered by the Companies and selected service establishments or other well-established companies, including by means of direct marketing; and (c) to comply with legal and regulatory requirements. Participants may withdraw their consent to (a) or (b) by contacting BlueLine at labattblueline@onlinetel.com or 1-866-900-BLUE (2583). The Service Provider reserves the right to monitor calls placed on the Service to identify call time, call origin, call destination and length of call.
The Service Provider, the Service Sponsors and their affiliates, contractors, agents and site providers are not responsible for any website links contained on this website, or the information contained therein.
Participants agree that all intellectual property in connection with the Service and/or this website, including (but not limited to) copyrights and trademarks, are owned by the Service Provider and/or the Service Sponsors and may not be used, copied, or altered for any purpose except as permitted expressly hereunder permitted.
These terms and conditions shall be construed and governed in accordance with the laws of the Province of Ontario.
