A man who once shared an apartment with his girlfriend and her husband has admitted to stabbing her after she tried to break up the love triangle.
But Faical Labidi denies he meant to kill her.
Yesterday the 38-year-old North York man pleaded not guilty to first-degree murder in the death of Ling Wang, 32, but guilty to manslaughter.
Labidi had a stormy romantic relationship with Wang, and at one time shared a bedroom with her in the same residence as her husband, said Crown prosecutor Erin Pancer as she outlined the evidence she and co-counsel Helen How expect to call.
But the relationship between Labidi and his lover deteriorated until finally, on the afternoon of Nov. 7, 2002, he made a call to a 911 operator.
"I killed my girlfriend," he said, as he stood by her car in the parking lot of his Rexleigh Dr. apartment building. She lay in the front seat of the car with 12 stab wounds to her chest, front, back and arm. Five of those wounds were fatal, according to facts jointly entered by the Crown and defence lawyer Daniel Brodsky.
When the operator asked if the couple had quarrelled, Labidi replied: "Yeah, we've been separated for a week or 10 days," according to a tape of the 911 call played in court.
It is anticipated the jury will hear that one of the items seized from Labidi was a "Dear Faical" letter from Wang, explaining why she was leaving him, Pancer said.
Wang came to Canada from Hong Kong in April 2001, leaving her husband Alex Chen in China, but immediately began the process of sponsoring him as a landed immigrant, according to evidence.
Then Wang, a seller of pharmaceutical and medical equipment, met Labidi on a trip to Montreal and they eventually started a romance. Wang told her husband about the affair while he was in China.
She promised to end it, but when he arrived in Canada she still had not. Nonetheless, he moved in with his wife and Labidi.
Chen is expected to testify that he witnessed several fights between the lovers, Pancer said. Labidi once accused Wang of ruining his life and promising he would be her "worst nightmare," the prosecutor said.
While Labidi was in Vancouver, the husband and wife moved out of the apartment without leaving a forwarding address, Pancer said.
Wang continued to talk to and meet with Labidi, but finally wrote the "Dear Faical" letter, Pancer said.
On Nov. 7, she picked him up at his Kraft Canada workplace in North York. Co-workers will likely testify that before he left he seemed unhappy and told them "things are going so badly all I can do is kill myself or kill somebody else," Pancer said.
Labidi and Wang went to lunch at about noon. Less than two hours later she was dead.
