1. Before you ask for a divorce, you OR your spouse must have lived in Ontario for a year before you ask for a divorce.
Since you are here less than 1 year, unless your husband had been here for more than 1 year, you have to wait before you ask for a divorce.
2. You can ask for a divorce if one of these things is true:
*You and your spouse have been apart for A YEAR (you must NOT have lived with your spouse for more than 90 days of that year)
*There is cruelty in your marriage
*One of you has committed adultery
After you ask for a divorce, and your spouse does not respond, it usually takes THREE to FOUR months for it to go through the court and become final. If you have children, or if you and your spouse disagree about something, then it will take longer.
Please notice that there are only the above three reasons that can lead to divorce in Ontario. You have to fit into one of the category. Otherwise, even if both of you agree to get divorced, you cannot get divorced. This is very tricky.
3. There are some organizations you can ask for help, such as legal clinic. Go to libray to find legal services offered in your closest legal clinic. I know that there is one at North York Center subway station. You can make a call for appoinment. They offer 30 minutes free consulting.
